請仔細閱讀M·A·C LOVER 會員獎賞計劃的參與條款及細則。參加本計劃即表示您同意接受本文所載的各項條款及以引用的方式納入本文的全部條款的約束。如果您不同意其中任何條款,請不要參與本計劃。
1. 參與資格及計劃概況
1.1 M·A·C LOVER 會員獎賞計劃("本計劃")由雅詩蘭黛(香港)有限公司和雅詩蘭黛(澳門)有限公司營運的M·A·C Hong Kong("M·A·C Hong Kong"、"本公司" 或 "我們")全權決定提供。本計劃只供個人使用,且每人僅限一個帳戶。公司、協會或其他團體不得參與本計劃。M·A·C LOVER 會員獎賞計劃提供予年滿18歲及以上的個人加入。參加本計劃無須購買任何商品。雅詩蘭黛旗下公司的僱員以及本公司的業務合作夥伴或供應商的僱員及個人如因個人使用目的有興趣加入本計劃,可能無法享受本計劃的部分優惠。
1.2 一旦加入本計劃並成為本計劃的會員,即表示您(“您”或“會員”)同意,您已閱讀、理解並同意受M·A·C LOVER 會員獎賞計劃:參與條款及細則(“本條款”)以及我們可能作出的任何更改或修訂所約束。因本條款不時會有所更改,您應時常查看本條款及相關政策和常見問題,以便及時了解本計劃適用之條款及細則的變化。本條款不會以任何方式改變您可能與我們簽訂的任何其他協議之條款或條件,包括任何產品或服務協議。登記參加本計劃即表示您同意接受以引用的方式納入本文的我司網站上的 私隱政策 及 條款及細則的約束。如果您不同意本條款、我司網站上的私隱政策及條款及細則,則您不能參與本計劃。本計劃任何內容如為法律所禁止,該等內容會被視作無效。
1.3 M·A·C LOVER 計劃只在M·A·C Hong Kong於香港或澳門營運的分店(以下單稱及合稱 “分店”)及專櫃(以下單稱及合稱“專櫃”)以及www.maccosmetics.com.hk(“網上商店”) 提供。
2. 加入計劃
2.1 合資格的個人可通過以下任何一個方式登記參加本計劃:
2.1.1 瀏覽 www.maccosmetics.com.hk,按照有關本計劃的提示註冊加入本計劃。
2.1.2 前往任何分店或專櫃,並告知店員您希望註冊參加本計劃。
2.2 登記參加需要提供您的法定姓名(顯示於您的法定身份證明文件上,例如香港身份證上)、手機號碼、電郵地址、生日月份及所在地。如果通過網上商店登記,您還必須自設密碼進行註冊。如果您通過網上商店登記參加,您明白您的個人資料會在公開的網絡上被收集,可能缺乏足夠的安全保障。如要獲得生日驚喜,您需要向我們提供您的生日月份。您也可以向我們提供您偏好的稱謂、郵寄地址和年齡組別,但這些屬選填資料。您需要自行負責維持您的帳戶內的資料的準確性以及根據需要作出更新。您可以在網上商店或聯絡客戶服務更新您的個人資料。
2.3 本計劃內的每一個帳戶只能與一個會員、一個手機號碼及一個電郵地址聯繫。如本計劃註冊會員的身份存在爭議,以註冊時提交的電郵地址或手機號碼的授權帳戶持有人為準。就本條款而言,“授權帳戶持有人”是指從互聯網供應商、網上服務供應商或負責為所提交電郵地址相關聯的網域分配電郵地址或手機號碼的其他組織(例如企業、教育機構等)處分配獲得所提交電郵地址或手機號碼的自然人。
3. 運作方式及優惠
3.1 本計劃是我們用於獎勵和感謝我們忠誠的客戶購買我們的產品和/或參與本計劃其他相關活動的一種方式。您可以通過購買合資格的產品或參與其他會員獎賞計劃活動來賺取積分和解鎖本計劃的會員獎賞等級。您在M·A·C Hong Kong於香港或澳門的分店或專櫃或在www.maccosmetics.com.hk作出的合資格購買每達到HK$1或MOP$1,即可獲得至少1分,除了這些購買外,我們可能會不時提供更多方式供您賺取和/或加速賺取積分。關於合資格的產品購買及其他解鎖會員獎賞等級的機會,將在網上商店上發佈,或通過其他媒體(例如門市、推廣短訊及電郵、社交媒體等)公佈。
一旦您賺取一定數量的積分和/或解鎖某個會員獎賞等級,您將有資格獲得適用於該等級和/或根據合資格年度(定義如下)內累積的總積分數量相應的專屬優惠和獎勵,這些優惠可能會不時作出調整,且供應有限。歡迎到訪我們的常見問題頁面,了解更多關於優惠的資訊。
3.2 本計劃是一個按等級訂立的獎勵計劃,在每一個7 月1日至6月30日的期間(此期間您所累積的合資格購物及活動為“合資格年度”),通過滿足一定金額的合資格購物及其他合資格的活動而定。您的第一個合資格年度由會員加入當日起開始至隨後的6月30日為止。本計劃共有三個相關優惠等級:
• 第一級,LOVER $0 – $1,499
• 第二級,DEVOTED $1,500 – $3,499
• 第三級,OBSESSED$3,500或以上
當您在第一個合資格年度加入時,您將自動歸入第一級即LOVER 級,此時您有資格獲得第一級會員享有的所有優惠。一旦您在加入計劃後並於下一個6月30日或之前,合資格的購物金額達到至少$1,500,您將自動升至第二級即DEVOTED 級。如果您在加入計劃後並於下一個6月30日或之前,合資格的購物金額達到$3,500 或更多,您將達到第三級即OBSESSED級。
您達到某一特定等級後,在該合資格年度的剩餘時間內及隨後的合資格年度內,您的等級可保持不變。其後,每個合資格年度您將需要達致足夠的合資格購物方可維持在這一等級。例如:
• 如果您在第一個合資格年度內達到第二級即DEVOTED 級,則第二個合資格年度內您仍可保留為DEVOTED 級。但是,如果您在第二個合資格年度內累積的合資格購物金額低於$1,500,則您的等級將在第三個合資格年度降回第一級即LOVER 級。
• 如果您在第一個合資格年度內達到第三級即OBSESSED級,則第二個合資格年度內您仍可保留為OBSESSED級。但是,如果您在第二個合資格年度內累積的合資格購物金額低於$1,500,則您的等級將在第三個合資格年度降回第一級即LOVER 級。
3.3 爲了使您的購買符合本計劃的資格,您必須已經註册加入本計劃,並且必須在購買時提供您的會員獎賞計劃會員識別資料,可以透過網上商店登錄進入您的帳戶,也可以在任何分店或專櫃提供您用於會員註冊的完整法定姓名,顯示相同的完整法定姓名的法定身份證明文件、您的手機號碼或註册電郵地址。如要獲得獎勵和禮遇,您必須購買合資格的産品和服務。合資格的購買包括正價產品和服務,不包括禮品卡、折扣、送貨費、運費或其他除外費用和/或我們不時說明的購買包括但不限於將資金捐贈給M·A·C Viva Glam Fund或其他慈善機構的慈善產品、優惠套裝、精選產品及服務和其他指定產品。在網上商店購物賺取的所有積分須待您的訂單發貨後,方可計入您的帳戶。如果您在購買時並非M·A·C LOVER 會員,您必須在購買後24小時內使用您在購買時提供的電郵地址在分店或專櫃或www.maccosmetics.com.hk上進行註冊,方有資格就該項購買累積積分。但是,如果您在本計劃中的會員資格因任何原因被終止並且您註冊了一個新的會員帳戶,則在您註冊新的帳戶之日前所作的任何購買均無法累積積分。
3.4您須親身到任何分店或專櫃進行兌換獎勵(包括任何禮遇和/或積分)。在非M·A·C Hong Kong於香港或澳門營運的的百貨公司、專賣店、店舖及專櫃,以及在香港或澳門以外進行的購買,均不適用本計劃。請參閱第4.1節了解如何兌換獎勵和禮遇。
3.5 除上述購買外,您還可以通過在網上商店或分店或專櫃內採取某些行動而獲得積分。關於在網上商店或分店或專櫃內賺取積分的現行方式清單,請參見我們的常見問題。如需賺取積分,您必須已經是本計劃會員,並且必須在採取相應行動之前提供您的會員獎賞計劃會員識別資料,可以透過網上商店登錄進入您的帳戶,也可以在任何分店或專櫃提供您用於會員註冊的完整法定姓名,顯示相同的完整法定姓名的法定身份證明文件、您的手機號碼或您的註册電郵地址。每一項行動可獲得的積分(如有)數量由M·A·C Hong Kong自行合理地酌情決定,並且在任何情況下均不得超過每一個合資格年度內每項行動可獲得的積分數量上限。
3.6 我們保留權利變更本計劃的各項禮遇、您解鎖各個會員獎賞計劃等級的方式,以及我們對於您作出的合資格購買和/或其他會員獎賞計劃活動進行評估和獎勵的方式。我們保留權利對於達到本計劃和/或任何特定等級的購買或活動的數量作出限制,對於您在任何特定等級或特定期間或在本計劃存續期間可能獲得或賺取的獎勵或優惠的數量或類型作出限制,和/或同時作出前述多項限制。
3.7 如果您擔心某項購買或其他活動未適當計入您的帳戶,您應通過 cs@maccosmetics.com.hk 與M·A·C Hong Kong客戶服務部聯絡。請務必在電子郵件中註明您用於會員註冊的完整法定姓名,顯示相同的完整法定姓名的法定身份證明文件、、地址、手機號碼以及與本計劃有關的電郵地址、進行本計劃活動的具體日期以及您遇到的問題。該電子郵件須在該購買或其他本計劃活動發生之日後四十五(45)天內發出。對於收到的關於購買或其他本計劃活動未計入帳戶的延遲通知,我們概不承擔責任。
3.8 積分自您加入本計劃當天起計,有效期至下一個6月30日。在隨後的7月1日當天,您未使用的積分將會過期及喪失。您的積分在7月1日當天重設為零,您需開始累積新的積分優惠及賺取新的積分獎勵。
4. 產品獎勵和優惠
4.1 作為本計劃的會員,您所賺取的積分將決定您的積分優惠。您須親身到門市(分店或專櫃)進行兌換產品獎勵和樣品。您須在分店或專櫃內向店員提供您的會員獎賞計劃會員識別資料(例如您用於會員註冊的完整法定姓名,顯示相同的完整法定姓名的法定身份證明文件、註冊電郵地址和/或手機號碼)方可使用您的獎勵和優惠。出示法定身份證明文件的唯一目的是為了核對您在會員註冊記錄中的姓名。為避免疑義,任何身份證明文件的號碼或身份證明文件的的副本並不會被收集。如果我們合理地認為無法確認您是相關計劃會員賬戶的所有者的情況下,我們會保留拒絕您請求兌換獎勵和禮遇的權利。
4.1.1您可以使用部分或全部積分兌換一定零售價值的產品獎勵。請前往我們的各個分店或專櫃查看最新的獎勵產品。獎勵產品需視乎存量。這些獎勵按照您在相應的合資格年度內所累積的積分數為基礎。當您兌換積分獎勵,我們將從您的積分結餘扣除該等獎勵對應的積分。您必須在下一個6月30日或之前兌換可用的積分/獎勵,否則未使用的積分和獎勵將會過期。您的積分將在下一個7月1日重設為零,屆時您需開始累積新的積分優惠及賺取新的積分獎勵。
4.1.2 等級優惠: 部分優惠是基於您所達到的會員等級而提供,在您處於某一等級期間,無論您當前擁有多少積分,您均有資格享受該等級對應的優惠。會員等級優惠可以在各個分店或專櫃中進行兌換,並視乎優惠而定。在下一個7月1日當天,即使您的積分重設為零,您的等級將根據您在上一個合資格年度的合資格購物金額而決定。關於如何兌換您的等級優惠的更多資訊,請參閱我們的 常見問題。
4.2 無論帳戶或是本計劃的獎勵、優惠和/或積分均不得轉讓、共享或同時使用。只有付費產品的會員可累積獎勵、優惠和/或積分。會員的任何購物消費如由無資格參與本計劃的企業或其他組織報銷,該等消費則無法獲得獎勵、優惠和/或積分。我們保留監測每戶帳戶數量以及隨時拒絕、合併或關閉額外或重複帳戶的權利。您的帳戶資料(包括安全性詳細資料)為保密信息,不應與任何其他人共享。
4.3 通過本計劃獲取的禮遇、獎勵和/或積分不具有現金價值,不可轉讓,且您對獎勵或本計劃中的其他禮遇不享有任何財產權利。如因為部分或全部的購買被退回或取消,或者是通過欺詐性的或其他違反本條款活動而獲得的積分,已計入本計劃帳戶的積分將被下降或撤回(如適用)。除本公司以外,明確禁止任何人通過本計劃出售、交換、轉移或轉讓任何獎勵或禮遇。本計劃所賺取的獎勵而産生的任何適用稅項責任均由會員負責。
4.4 獎勵不得退換為積分、其他產品或服務或作現金退款。
4.5 通過本計劃提供的產品和服務以及我們向您提供的任何樣品僅供您個人使用。您不得出售或轉售您購買的或以其他方式從我們收到的任何產品、服務或樣品。我們酌情處理我們認為可能導致違反本條款的任何待完成訂單和/或將向您提供的任何產品或服務,並保留權利取消或減少該等要執行的訂單和/或向您提供的產品或服務的數量而不作另行通知。
4.6 我們保留根據下文第6條規定作出下列行為的權利:
•變更本計劃的各項優惠、如何達到各個會員獎賞計劃等級、如何賺取積分,以及我們如何評估及獎勵您所作出的合資格購買和/或參與其他會員獎賞計劃活動;
•對於達到本計劃和/或任何特定等級或積分等級的購買或活動的數量作出限制,對於您在任何特定等級或任何特定積分等級、特定期間或在本計劃存續期間可能獲得或賺取的獎勵或優惠的數量或類型作出限制,和/或同時作出前述多項限制。
5. 有關本計劃的通訊
5.1 您註冊加入本計劃,您將自動訂閱收到與本計劃相關的通訊。只有在您表示同意接收市場推廣資訊之後,您才會通過您同意的渠道,收到與M·A·C Hong Kong和本計劃相關的市場推廣通訊。
5.2 您可以按照上述通訊中提供的指示以及M·A·C Hong Kong私隱政策另行規定的方式,隨時選擇不再接收市場推廣資訊或與本計劃相關的消息,但您仍將收到營運性通訊,因該等通訊涉及您在本計劃中的會籍。營運性通訊的示例包括但不限於兌換確認電郵、個人資料更新電郵或其他與您的帳戶相關的通訊。如果您終止您的會籍,您將不會再收到任何與本計劃有關的通訊。
6. 終止和修改
6.1 我們可能不時取消、修改、限制或終止本條款、我們的常見問題和/或本計劃或本計劃的任何方面或特點,且該等變化可能會影響已累積或賺取的獎勵或優惠的價值和/或兌現已累積獎勵或優惠的能力。如果本條款、我們的常見問題和/或本計劃有任何重大變化或被取消、修改或限制,我們將盡合理努力,以書面、電郵、短訊等形式或通過在網上商店上公告或我們的其他渠道提前通知您。您應當時常查看本條款和常見問題,以便了解適用於本計劃的條款及細則。本條款和常見問題的最近一次更新日期將在網站上清楚標明,該次更新所做的更改將僅從所標明之日起生效。如果您不同意本條款、常見問題和/或本計劃的任何變更,可以根據第6.3條的規定撤銷您的會員資格。
6.2 我們保留以下權利:按我們全權的合理決定,隨時拒絕或終止您參與本計劃並審核您的會員帳戶。任何涉嫌濫用本計劃、不遵守本條款規定、進行非法活動、欺詐、虛假陳述或我們認為(合理行事)與本條款不符和/或對我們或我們的利益有害的其他行為,包括但不限於任何涉嫌非法、欺詐或其他未經授權使用本計劃任何獎勵、積分、卡、餘額、購物券、優惠券和/或證明書的行為,都可能導致您的會員資格被取消,並且您不再有資格繼續參與本計劃。如果您的會員資格被取消,您帳戶中的任何獎勵或優惠將自動失效,您對本計劃及其功能的使用將自動終止。如果我們懷疑存在非法活動、欺詐、虛假陳述、濫用或違反本條款的情形,我們也有全權自行決定採取適當的法律行動。
6.3 如果您決定不再參與本計劃,可以按照下文 第11條中的聯絡方式聯絡客戶服務部取消您的會員資格。如果您自行注銷會員資格,您將失去所有已累積的積分、優惠且您的等級狀態將自動過期。
7. 不作保證;責任限制
7.1 在適用法律容許的最大範圍內,M·A·C Hong Kong及我們的母公司、子公司、關聯方、合作夥伴或許可方無論是基於合同、保證或侵權(包括過失),均不對以下任何情形承擔責任:(a)業務中斷;(b)對本計劃的使用延遲或中斷;(c)數據未送達、丟失、被盜、誤送、損壞、破壞或被以其他方式修改;(d)由於在網站上處理或出現第三方鏈接或由於使用本計劃的任何獎勵或優惠而導致的任何類型的損失或損害;(e)與您使用網站相關的可能發生的電腦病毒、系統故障或失靈,包括通過超鏈接前往第三方網站或從第三方網站轉登過程中可能發生的電腦病毒、系統故障或失靈;(f)本計劃內容中的任何不準確或遺漏;或(g)超出我們合理控制範圍的事件。我們不作任何關於將會糾正缺陷或錯誤的陳述或保證。
7.2 此外,M·A·C Hong Kong及我們的母公司、子公司、關聯方、合作夥伴或許可方對於與本計劃或您參與本計劃有關的任何種類的任何間接、特殊、懲戒性、附帶或後果性損害(包括但不限於利潤損失),不論是基於合同、保證或侵權(包括過失),概不承擔責任,即使我們已被告知可能發生該等損害。在適用法律容許的最大範圍內,在任何情況下,我們的最高責任限額合計不超過壹千(1,000.00)港元。
7.3 在適用法律容許的最大範圍內,您同意,因您參與本計劃、使用任何獎勵或其他優惠或本條款而產生的或與之相關的任何基於合同、保證或侵權(包括過失)的索償或訴訟,不得在該等索償或訴訟涉及的訴因發生超過一(1)年後提出。
8. 彌償
對於因您參與本計劃違反任何法律、規則、法規或本條款而導致的任何第三方索償、訴訟或要求而產生的任何損失、損害賠償或費用(包括合理的律師費),您同意為我們、我們的母公司、子公司、關聯方、合作夥伴、許可方、管理人員、董事、僱員和代理人進行辯護、作出賠償並使我們免受損害。
9. 管轄法律及爭議
9.1 本計劃及本條款受香港的法例管轄並依其解釋,您接受香港法院的專屬管轄權。
9.2 以任何方式與本計劃、本條款、您在本計劃中的會員資格或雙方關係有關的任何爭議,均應在香港通過保密仲裁解决,而您同意接受香港的司法管轄權及法律程序的規管。仲裁是指由一名仲裁員就相關索賠作出裁决,您無權在法院起訴,也無權讓法官或陪審團就您的索賠作出裁决。您在聆訊前交換資料和上訴的權利也可能在仲裁中受到限制。雙方進一步商定,任何有關本仲裁條款範圍的爭議和任何有關申索是否可以仲裁的爭議,均應提交仲裁員裁决。儘管如上所述,但在您以任何方式違反或威脅違反我們的知識産權或我們關聯方、合作夥伴或許可方的知識産權,或在其他情况下基於衡平法具訴訟因由之範圍內,我們可在任何具有管轄權的法院尋求禁令或其他適當的救濟,而就該目的您同意任何該等法院的司法管轄權和地點。根據本條款進行的仲裁應根據香港國際仲裁中心屆時實施的仲裁規則進行。仲裁員的裁决具有約束力,並且可以在任何有管轄權的法院登記爲判决。
9.3 您同意,任何仲裁或訴訟應僅限於我們與您個人之間的爭議,並且:
(i)任何仲裁或訴訟均不得與任何其他仲裁或訴訟合併;
(ii)各方均無權利或權限以集體訴訟形式或利用集體訴訟程序進行仲裁或解決任何爭議;以及
(iii)各方均無權利或權限以充作代表身份代表公衆或他人提出爭議。您同意,您只能以個人身份向我們提出申索,不能以任何宣稱的集體訴訟或代表人訴訟中的原告人或集體成員身份向我們提出申索。
10. 私隱
我們重視你的私隱。就本計劃向您收集的個人資料,包括但不限於與您在本計劃中的會籍下有關的購買資料,將由我們爲了以下目的而使用和披露:管理本計劃、與本計劃相關的市場推廣、發送您選擇接收的其他市場推廣電子郵件或短訊,和/或向您提供通過我們的網上商店要求的服務、內部分析以及我們的私隱政策所允許的其他目的。爲了本條款中所述的目的,我們可能會與根據我們的指示代表我們提供服務的服務提供商共享您的個人資料。我們可能會將您的個人資料傳送至最初收集資料地點以外的司法管轄區。

12. 可分割
如果本條款中的任何規定部分或全部不可強制執行,該等規定將從本條款中分割出來,本條款的其餘部分仍將繼續保持完整效力。

PLEASE READ THESE TERMS AND CONDITIONS OF PARTICIPATION IN THE M·A·C LOVER LOYALTY PROGRAM CAREFULLY. BY PARTICIPATING IN THIS PROGRAM, YOU AGREE TO BE BOUND BY THE TERMS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT PARTICIPATE IN THIS PROGRAM.
1. Membership Eligibility and Overview
1.1 The M·A·C LOVER Loyalty Program (“Program”) is offered at the sole discretion of M·A·C LOVER Hong Kong operated by Estee Lauder (Hong Kong) Limited and Estee Lauder (Macau) Limited (“M·A·C Hong Kong,” “we,” “our” or “us”). The Program is available to individuals for their personal use only and is limited to one account per individual. Corporations, associations or other groups may not participate in the Program. Individuals who are at least 18 years old and who provide and maintain a valid email address are eligible to become members. Employees of the Estée Lauder companies and employees and individuals employed by our business partners or vendors who are interested to join this Program for personal use will not be eligible for certain Program benefits.
1.2 By joining the Program and becoming a Program member, you (“you,” “your,” or “Member”), agree that you have read, understood and agreed to be bound by these Program Terms and Conditions of Participation (“Terms”) and by any changes or modifications we may make. You should review these Terms and the related policies and FAQs frequently to understand the terms and conditions that apply to the Program as they may change from time to time. These Terms do not alter in any way the terms or conditions of any other agreement you may have with us, including any agreement for products or services. By enrolling in the Program, you also agree to be bound by our website PRIVACY POLICY and our website TERMS AND CONDITIONS, which are incorporated herein by reference. If you do not agree to these Terms, our website PRIVACY POLICY, and our website TERMS AND CONDITIONS, you cannot participate in the Program. The Program is void where prohibited by law.
1.3 The M·A·C LOVER Program is only available in M.A.C Hong Kong owned and operated stores (collectively “Stores”, and each a “Store”) and counters in Hong Kong and Macau (*excluding at Sephora, Duty Free and airport locations) (collectively "Counters", and each a "Counter") and on www.maccosmetics.com.hk (“Online”) within Hong Kong or Macau.
2. Program Enrollment
2.1 Eligible individuals may enroll in the Program through one of the following options:
2.1.1 Visit www.maccosmetics.com.hk and follow the Program prompts to register for the Program.
2.1.2 Visit any Store or Counter and tell a store associate you would like to register for the Program.
2.2 You are required to provide your full legal name (as shown on your legal proof of identity document, e.g. a Hong Kong Identity Card), mobile phone number, email address, birth month and location in order to enroll. If you enroll Online, you must also create a password in order to enroll. If you are enrolling Online, you understand that your personal data is being collected on an open network, which may not have sufficient security measures. In order to access your birthday surprises, you will need to provide us with your birth month. You will also have the opportunity to provide us with your preferred salutation, mailing address and age group, but this information is optional. You are solely responsible for maintaining the accuracy of your account information and for updating it as required. You may update your personal information Online or contact Customer Service.
2.3 Only one Program account may be associated with a single member and a single email address and mobile phone number. In the event of a dispute over the identity of the member enrolled in the Program, the member will be deemed to be the authorized account holder of the email address or mobile phone number submitted at the time of enrollment. For purposes of these Terms, the "authorized account holder" is the natural person who is assigned to the submitted email address or mobile phone number by an internet provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address or mobile phone number.
3. How the Program Works
3.1 The Program is a way in which we reward and thank our loyal customers for purchasing our products and/or taking other Program related actions. You are able to earn points and also unlock Program loyalty tiers by making eligible purchases or taking certain other Program actions. You will receive at least 1 point for every HK$1 or MOP$1 spent on qualifying purchases in any Store or Counter or at www.maccosmetics.com.hk and in addition to these purchases, we may offer more ways to earn and/or accelerate your points from time to time. Eligible purchases and other opportunities to unlock Program loyalty tiers will be posted at www.maccosmetics.com.hkor may be published through other media (e.g., in-store, in marketing emails, social media, etc.).
Once you have accumulated points and/or unlock a certain loyalty tier, you may be eligible for certain benefits and rewards applicable to that tier and/or based on the total number of points you have accumulated in a Qualifying Year (defined below), which benefits may change from time to time and may be offered on a limited basis. 3.2 The Program is a tier-based program determined by the qualifying spend on eligible purchases and through qualifying activities, calculated every July 1 to June 30 (each period in which you accumulate qualifying spending and activities, a “Qualifying Year”). Your first Qualifying Year begins on the date you enrol in the Program and ends on the following June 30. There are 3 tiers with associated benefits:
• Tier 1, LOVER $0 – $1,499
• Tier 2, DEVOTED $1,500 – $3,499
• Tier 3, OBSESSED $3,500 or above
When you join in the first Qualifying Year, you'll automatically be placed in Tier 1, LOVER and be eligible for all the benefits Tier 1 members receive. Once you spend at least $1,500 on eligible purchases in your first Qualifying Year, you'll be automatically moved up to Tier 2, DEVOTED. When you spend $3,500 or more on eligible purchases in your first year, you'll be qualified for Tier 3, OBSESSED.
Your status in a particular tier is good for the remainder of the Qualifying Year in which you qualify for that tier and the following full Qualifying Year. After that, you'll need to spend enough to qualify for that tier on a yearly basis subsequently. For example:
• if you qualify for Tier 2, DEVOTED, during your first Qualifying Year, you'll maintain DEVOTED status during your second Qualifying Year. But, if you spend less than $1,500 on eligible purchases during your second Qualifying Year, you'll drop back down to Tier 1, LOVER status starting on your third Qualifying Year.
• if you qualify for Tier 3, OBSESSED, during your first Qualifying Year, you’ll maintain OBSESSED status during your second Qualifying Year. But, if you spend less than $1,500 on eligible purchases during your second Qualifying Year, you’ll drop back to Tier 1, LOVER status starting on your third Qualifying Year.
3.3 For your eligible purchase to qualify for the Program, you must be enrolled in the Program and you must provide your Program member identification at the time of purchase by logging into your account at www.maccosmetics.com.hk or by providing your name, mobile phone number or your registered email address in any Stores or Counters. To earn rewards and benefits, your purchase must be made on qualifying products and services. Eligible purchases include regular priced merchandise and services, and exclude gift cards, discounts, shipping charges, delivery charges and other excluded charges and/or purchases as specified by us from time-to-time, including, but not limited to, charitable products where funds are donated to M·A·C Viva Glam Fund or any charitable organization, value sets, select premium products and services, and other specified products. All points earned from purchases Online are pending until your order ships. If you are not a member of M·A·C LOVER at the time of purchase, you must enroll in Store or Counter or on www.maccosmetics.com.hk within the next 24 hours, using the same email address you provided at the time of purchase, in order to be eligible to earn points on that purchase. However, if your membership in the Program is terminated for any reason and you enroll in a new Program account, any purchases made prior to the date you enroll in a new Program account do not qualify for points.
3.4 Rewards (including any benefits and/or points) can only be redeemed in any Stores or Counters in person. Purchases made in department stores, specialty stores, stores and/or counters not solely owned and operated by M.A.C Hong Kong and outside of Hong Kong or Macau are not eligible for the Program. Please refer to section 4.1 on how to redeem rewards and benefits.
3.5 In addition to these purchases, you may also earn points for taking certain Program actions Online or in Stores or Counters. Please see our FAQs for a list of the current ways to earn points Online or in Stores or Counters. To earn points, you must be a Program member and provide your Program member identification before completing the actions, by logging onto your Program account or by providing your Program member identifying information (e.g. name, registered email address and/or mobile phone number) to a store associate in a Store or Counter. The number of points, if any, awarded for each action is determined by M.A.C Hong Kong in its sole but reasonable discretion and in all cases subject to a maximum number of points earned for each action per Qualifying Year.
3.6 We reserve the right to change Program benefits, how you unlock each Program tier and how we evaluate and reward your eligible purchases and/or other Program activity. We reserve the right to place limits on the number of purchases or activities that are eligible for the Program and/or for any given tier, the number or types of rewards or benefits you may receive or earn in any given tier, in a given time period or for the duration of the Program, and/or any combination thereof.
3.7 If you have concerns that a purchase or other activity was not properly applied to your account, you should contact M.A.C Hong Kong Customer Service at cs@maccosmetics.com.hk. Your email must specify your name, address, mobile phone number, and email address associated with the Program, the date of the Program activity, and the issue(s) you encountered. This email must be sent no more than forty-five (45) days after the date the purchase or other Program activity took place. We are not responsible for late notifications about purchases or other Program activities not being credited to an account.
3.8 Points are valid until next June 30 from your enrollment date. All unused points will expire and be forfeited on the following July 1. On July 1, your points will be reset to zero and you may start accumulating new points and earning new point rewards.
4. Product Rewards and Benefits
4.1 As a member, you earn points to determine your points benefits. Product rewards and samples are redeemable in-Store (either Stores or Counters) in person. You must provide your Program member identifying information (e.g. full legal name which you have used for membership registration, legal proof of identity document which shows the same full legal name (e.g. Hong Kong Identity Card), registered email address and/or mobile phone number) to a store associate in a Store or Counter to use your rewards and benefits. Your production of a legal proof of identity document will be for the sole purpose of cross-checking your name as shown in your membership registration records. For the avoidance of doubt, no identity document numbers or copies of your identity documents will be collected. We reserve the right to refuse your request to redeem rewards and benefits in the event we are unable in our reasonable opinion to ascertain your identity as the owner of the relevant Program membership account.
4.1.1 You are eligible to redeem some or all of these points for product rewards of certain retail value. Please visit our Stores or Counters to see the latest reward offerings. Reward offerings are subject to availability. These rewards are based on the number of points you have accumulated based on your qualified spending in the corresponding Qualifying Year. Once you have redeemed your point reward, your points balance will be reduced by the applicable points value for that reward. You must redeem your available points and/or rewards on or prior to June 30, or the unused points and rewards will expire. On July 1, your points reset to zero (0) and you may start accumulating new points and earning new rewards.
4.1.2 Tier Benefits:
Certain benefits are based on the tier achieved and you are eligible for these benefits while you are in that tier regardless of the number of points you currently have. Tier benefits can only be redeemed in Stores or Counters in person with the exception of exclusive bonus points events and VIP events or as otherwise notified. On July 1, even though your points reset to zero, your tier status is determined by the qualified spending in the prior Qualifying Year. Please review our FAQs for more information on how to redeem your tier benefits.
4.2 Neither accounts nor Program rewards, benefits and/or points may be transferred, shared or combined. Only the member paying for the product(s) may accumulate rewards, benefits and/or points. Members will not receive rewards, benefits and/or points on purchases which are reimbursed by corporations or other organizations ineligible to participate in the Program. We reserve the right to monitor the number of accounts per household and refuse, merge or close additional or duplicate accounts at any time. Your account information (including security details) is confidential and should not be shared by you with any other person.
4.3 Rewards, benefits and/or points earned through the Program have no cash value, are non-transferable, and you have no property rights in or to rewards or other Program benefits. Points credited to your Program account will be decreased or reversed, as applicable, if part or all of the purchase is returned or cancelled or if the credit is obtained through fraudulent or other activity that violates these Program Terms. The sale, barter, transfer, or assignment of any rewards, benefits or points offered through the Program, other than by us, is expressly prohibited. Any applicable tax liabilities resulting from rewards earned under the Program are the responsibility of the member.
4.4 Rewards cannot be exchanged or returned for points, another product, service or a monetary refund.
4.5 The products and services available through the Program and any samples that we may provide to you are for personal use only. You may not sell or resell any of the products, services, or samples you purchase or otherwise receive from us. We reserve the right, without notice, to cancel or reduce the quantity of any order to be filled and/or any products or services to be provided to you that we believe, in our sole discretion, may result in the violation of our Program Terms.
4.6 We reserve the right in accordance with section 6 below to:
• change Program benefits, how you reach each Program tier, how you earn points and how we evaluate and reward your eligible purchases and/or other Program activity;
• place limits on the number of purchases or activities that are eligible for the Program and/or for any given tier or point level, the number or types of rewards or benefits you may receive or earn in any given tier or at any given point level, in a given time period or for the duration of the Program, and/or any combination thereof.
5. Program Communications
5.1 By enrolling in the Program, you will be automatically subscribed to receive Program related communications. You will be subscribed to receive marketing communications related to M.A.C Hong Kong and the Program, only after you have indicated your consent to receive marketing information and only through the channels to which you have consented.
5.2 You may opt-out of receiving marketing information or Program-related messages at any time by following the instructions provided in such communications and as otherwise provided in the M.A.C Hong Kong Privacy Policy, but operational communications will still be sent to you as they relate to your membership in the Program. Examples of these include, but are not limited to, redemption confirmation emails, profile update emails, or other communications that relate to your account. If you terminate your Program membership, you will no longer receive any Program-related communications.
6. Termination and Modification
6.1 We may cancel, modify, restrict or terminate these Terms, our FAQs, and/or the Program or any aspect or feature of the Program from time to time, and such changes may affect the value of rewards or benefits already accumulated or earned and/or the ability to redeem accumulated rewards or benefits. We will use reasonable endeavours to provide advance notice to you of any material changes to or the cancellation, modification or restriction of these Terms, our FAQs and/or the Program in writing, email, SMS, MMS or by posting it Online or our other channels. You should review these Terms and the FAQs frequently to understand the terms and conditions that apply to the Program. The date of the latest update to these Terms and the FAQs will be stated clearly on the website and the changes made by that update will only apply from the specified date. If you disagree with any changes to these Terms, our FAQs and/or the Program, you may cancel your membership in accordance with section 6.3.
6.2 We reserve the right to exclude you from or to discontinue your participation in the Program and to audit your membership account at any time, in our sole reasonable discretion. Any suspected abuse of the Program, failure to follow any sections of these Terms, illegal activity, fraud, misrepresentation or other conduct which we consider (acting reasonably) to be inconsistent with these Terms and/or detrimental to us or our interests, including without limitation, any suspected illegal, fraudulent other unauthorized use of any Program rewards, points, cards, credits, vouchers, coupons and/or certificates, may result in the revocation of your membership and make you ineligible for further participation in the Program. If your membership is revoked, any rewards or benefits in your account will automatically expire and your access to the Program and features will automatically terminate. If we suspect illegal activity, fraud, misrepresentation, abuse or violation of these Terms, we also have the right to take appropriate legal action, in our sole discretion.
6.3 If you decide you no longer want to be a part of the Program, you may cancel your membership by contacting Customer Service per the contact information in section 11 below. If you cancel your membership, you will lose all accumulated points, benefits and your tier status will automatically expire.
7. Disclaimer of Warranties; Limitation of Liability
7.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER M.A.C HONG KONG NOR OUR PARENTS, SUBSIDIARIES, AFFILIATES, PARTNERS, OR LICENSORS WILL BE RESPONSIBLE OR LIABLE IN CONTRACT, WARRANTY OR IN TORT (INCLUDING NEGLIGENCE) FOR ANY (a) INTERRUPTION OF BUSINESS; (b) ACCESS DELAYS OR ACCESS INTERRUPTIONS TO THE PROGRAM; (c) DATA NON-DELIVERY, LOSS, THEFT, MISDELIVERY, CORRUPTION, DESTRUCTION OR OTHER MODIFICATION; (d) LOSS OR DAMAGES OF ANY SORT INCURRED AS A RESULT OF DEALINGS WITH OR THE PRESENCE OF THIRD PARTY LINKS ON THE SITE OR USE OF ANY REWARD OR BENEFIT OF THE PROGRAM; (e) COMPUTER VIRUSES, SYSTEM FAILURES OR MALFUNCTIONS WHICH MAY OCCUR IN CONNECTION WITH YOUR USE OF THE SITE, INCLUDING DURING HYPERLINK TO OR FROM THIRD PARTY WEBSITES; (f) ANY INACCURACIES OR OMISSIONS IN PROGRAM CONTENT; OR (g) EVENTS BEYOND OUR REASONABLE CONTROL. WE MAKE NO REPRESENTATIONS OR WARRANTIES THAT DEFECTS OR ERRORS WILL BE CORRECTED.
7.2 FURTHER NEITHER M.A.C HONG KONG NOR OUR PARENTS, SUBSIDIARIES, AFFILIATES, PARTNERS, OR LICENSORS WILL BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING BUT NOT LIMITED TO LOST PROFITS) RELATED TO THE PROGRAM OR AND YOUR PARTICIPATION THEREIN, WHETHER IN CONTRACT, WARRANTY OR IN TORT (INCLUDING NEGLIGENCE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OUR MAXIMUM AGGREGATE LIABILITY EXCEED ONE THOUSAND HONG KONG DOLLARS (HKD1,000.00).
7.3 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT NO CLAIMS OR ACTION IN CONTRACT, WARRANTY OR IN TORT (INCLUDING NEGLIGENCE) ARISING OUT OF, OR RELATED TO, YOUR PARTICIPATION IN THE PROGRAM, USE OF ANY REWARDS OR OTHER BENEFIT OR THESE TERMS MAY BE BROUGHT BY YOU MORE THAN ONE (1) YEAR AFTER THE CAUSE OF ACTION RELATING TO SUCH CLAIM OR ACTION AROSE.
8. Indemnification
You agree to defend, indemnify and hold us, our parents, subsidiaries, affiliates, partners, licensors, officers, directors, employees, and agents harmless for any loss, damages or costs, including reasonable attorneys' fees, resulting from any third party claim, action, or demand resulting from your participation in the Program in violation of any law, rule, regulation or these Terms.
9. Governing Law and Disputes
9.1 This Program and these Terms will be governed by and construed under the laws of Hong Kong, and you submit to the exclusive jurisdiction of the courts of Hong Kong.
9.2 ANY DISPUTE RELATING IN ANY WAY TO THIS PROGRAM, THESE TERMS, YOUR PROGRAM MEMBERSHIP, OR THE RELATIONSHIP BETWEEN THE PARTIES SHALL BE SUBMITTED TO CONFIDENTIAL ARBITRATION IN HONG KONG AND YOU AGREE TO SUBMIT YOURSELF TO THE JURISDICTION AND PROCEEDINGS THEREOF. ARBITRATION MEANS THAT A SINGLE ARBITRATOR WILL DECIDE THE CLAIM, AND YOU WILL NOT HAVE THE RIGHT TO SUE IN COURT OR TO HAVE A JUDGE OR JURY DECIDE YOUR CLAIM. YOUR RIGHTS TO PREHEARING EXCHANGE OF INFORMATION AND APPEALS MAY ALSO BE LIMITED IN ARBITRATION. It is further agreed that any dispute over the scope of this arbitration provision and any dispute as to whether a claim is arbitral shall be submitted to the arbitrator for decision. Notwithstanding the foregoing, to the extent you have in any manner violated or threatened to violate our intellectual property rights or the intellectual property rights of our affiliates, partners or licensors or otherwise have a cause of action in equity, we may seek injunctive or other appropriate relief in any court of competent jurisdiction and you consent to jurisdiction and venue in any such court for such purposes. Arbitration under these Terms shall be conducted under the prevailing Administered Arbitration Rules at the Hong Kong International Arbitration Centre. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction.
9.3 You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually, and
(i) no arbitration or proceeding shall be joined with any other;
(ii) there is no right or authority for any dispute to be arbitrated or resolved on a class action-basis or to utilize class action procedures; and
(iii) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons. YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST US ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
10. PRIVACY
We value your privacy. The personal information collected from you in connection with the Program, including but not limited to purchases made in connection with your Program membership, will be used and disclosed by us for the purpose of the administration of the Program, marketing in connection with the Program, sending other marketing emails or text messages that you have opted-in to receive, and/or for providing you with services requested Online, internal analysis and as otherwise permitted by our Privacy Policy. We may share your personal information, for the purposes described herein, with service providers who perform services on our behalf based on our instructions. We may transfer your personal information to a jurisdiction outside of the place where the information was originally collected.
